A month out: where Hursh v. State Farm stands before the Dec. 7 trial

The jury trial in Hursh v. State Farm Fire and Casualty Co. (Oklahoma County No. CJ-2025-2626) is set to begin December 7, 2026, before Judge Amy Palumbo. This page will add a dated update for each pretrial hearing and each day of trial, with the filings linked as they reach the public docket.

Before then, four motions, including both summary-judgment motions, are set for hearing November 13, and the pretrial conference is set for November 19, according to the court record.

Still pending as of the November 5 docket reads: State Farm's November 2 emergency motion asking the court to strike the homeowners' October 27 motion to enforce and its Exhibit 3, the Senior Executive Offsite memo known as Exhibit 133, and remove them from the public docket. State Farm also says it applied to the Oklahoma Supreme Court for a writ on October 27, the day after Judge Palumbo ruled the memo is not privileged.

On December 7 at 9 a.m., in the State of Oklahoma's separate lawsuit against State Farm, Judge Jeff Virgin in Cleveland County is set to hear State Farm's motion to disqualify Whitten Burrage, the firm representing the State and the homeowners in Hursh. The companion West case is set for trial in February 2027.

No court has decided the homeowners' claims, and State Farm denies them.

The case in brief

In Hursh v. State Farm Fire and Casualty Co., homeowners say State Farm wrongly denied their hail-damage roof claim and handled it in bad faith; State Farm denies the claims. Discovery in the case produced company documents that the homeowners say show how State Farm managed roof claims, including the Senior Executive Offsite memo known in court as Exhibit 133. A companion case, West v. State Farm (Comanche County No. CJ-2025-135), is set for trial in February 2027, and the State of Oklahoma has sued State Farm over its roof-claim practices (Cleveland County No. CJ-2026-1066). No court has decided the homeowners' claims.
